By accessing or using the website kearney.farm (the “Site”) or purchasing any products or services from Kearney Family Farm (KFF), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Site.

2. General E-commerce Conditions

• Eligibility: You must be at least 18 years of age or the age of majority in your jurisdiction to purchase products or services.
• Accuracy of Information: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.
• Product Descriptions: We attempt to be as accurate as possible. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free.
• Pricing: All prices are subject to change without notice. We reserve the right to modify or discontinue any product or service without notice at any time.

3. Orders, Payments, and Billing

• Order Acceptance: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
• Payment: Payments are processed through the WooCommerce platform. You agree to pay all charges at the prices then in effect for your purchases, including any applicable shipping fees and taxes.
• Cancellations: Orders can be canceled for a full refund if the request is made before the order has shipped. Once an order has shipped, it cannot be canceled.
• Taxes: You are responsible for any applicable taxes, duties, or tariffs associated with your purchase.

4. Returns, Exchanges & Damaged Items

Risk of Loss: The risk of loss and title for items purchased from KFF pass to you upon our delivery to the carrier.

General Policy: Due to the nature of our handcrafted, consumable products, and for reasons of food safety and hygiene, we do not accept returns or offer exchanges for products unless they are damaged, incorrect, or defective. We cannot accept returns for reasons of taste preference or change of mind.

Refunds: Refunds will be processed to your original method of payment within 5–10 business days after approval. Original shipping costs are non-refundable unless the entire order was incorrect or damaged.

5. Educational and Training Services (KDP)

• Enrollment: Enrollment in KFF training programs (e.g., KDP workshops, courses) is confirmed upon successful payment.
• Cancellation/Refunds (Training): Full refunds apply for cancellations 30 days prior to course start date. Cancellations between 7–30 days prior may incur a 25% fee. No refunds for cancellations under 7 days or no-shows.
• Curriculum: KFF reserves the right to modify course content, scheduling, and instructors at any time without notice.

6. Intellectual Property

• Ownership: Content on the Site, including text, graphics, logos, images, course materials, and the Kearney Development Platform (KDP) methodology, is the property of Kearney Family Farm and protected by copyright laws.
• License: Purchases grant a limited, non-exclusive, non-transferable license for personal, non-commercial use only.
• Prohibited Use: You may not reproduce, duplicate, copy, sell, or exploit any portion of the service or content without express written permission.

7. Disclaimers, Liability & Governing Law

Agricultural Disclaimer: All training and information provided by KFF are for educational purposes only. KFF does not guarantee specific agricultural outcomes or results and is not liable for business or crop decisions.

Limitation of Liability: Site content and products are provided ‘as is’ without warranties. KFF and its officers shall not be liable for direct, indirect, incidental, or consequential damages resulting from product or service use.

Governing Law: These Terms are governed by and construed in accordance with the laws of New York, United States.
