3. Orders, Payments, and Billing
- Order Acceptance: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
- Payment: Payments are processed through the WooCommerce platform. You agree to pay all charges at the prices then in effect for your purchases, including any applicable shipping fees and taxes.
- Cancellations: Orders can be canceled for a full refund if the request is made before the order has shipped. Once an order has shipped, it cannot be canceled.
- Taxes: You are responsible for any applicable taxes, duties, or tariffs associated with your purchase.
4. Returns, Exchanges, and Refunds (Physical Products)
- Risk of Loss: The risk of loss and title for items purchased from KFF pass to you upon our delivery to the carrier.
- General Policy: Due to the nature of our handcrafted, consumable products, and for reasons of food safety and hygiene, we do not accept returns or offer exchanges for products unless they are damaged, incorrect, or defective. We cannot accept returns for reasons of taste preference or change of mind.
- Refunds: Refunds will be processed to your original method of payment within 5-10 business days after the refund is approved. Original shipping costs are non-refundable unless the entire order was incorrect or damaged.
4A. Damaged or Incorrect Items Policy
- Reporting Period: You must notify us of any damaged, incorrect, or defective items within 7 days of receiving your order.
- How to Report: Email us at Support@kearneyfamily.farm with your order number, a clear description of the issue, and attach clear photographs of the damaged item(s) and the packaging (if relevant).
- Resolution: Upon verification, Kearney Family Farm will, at our discretion: Replace the affected item(s) at no additional cost; Issue a full refund for the affected item(s) or the entire order; or Provide store credit. You may not be required to return damaged or incorrect items.
5. Educational and Training Services (KDP)
- Enrollment: Enrollment in KFF training programs (e.g., KDP workshops, courses) is confirmed upon successful payment.
- Cancellation/Refunds (Training):
- Cancellations made [e.g., 30 days] before the start date of a course will receive a full refund.
- Cancellations made [e.g., 7-30 days] before the start date may be subject to a cancellation fee (e.g., 25% of the fee).
- No refunds will be given for cancellations made less than [e.g., 7 days] before the start date or for no-shows.
- Curriculum: KFF reserves the right to modify course content, scheduling, and instructors at any time without notice.
6. Intellectual Property
- Ownership: The content on the Site, including text, graphics, logos, images, course materials, and the Kearney Development Platform (KDP) methodology, is the property of Kearney Family Farm and is protected by copyright and other intellectual property laws.
- License: When you purchase a course or product, you are granted a limited, non-exclusive, non-transferable license to use the materials for your personal, non-commercial use only.
- Prohibited Use: You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the service, use of the service, or access to the service or any content on the website without express written permission from us.
7. Disclaimers and Limitation of Liability
- Regenerative Agriculture/Farming: All training and information provided by KFF are for educational purposes only. KFF does not guarantee specific results from the application of farming techniques and is not liable for any business decisions, losses, or damage to crops/livestock resulting from such application.
- Disclaimer of Warranties: The site and all products and services delivered to you through the site are provided ‘as is’ and ‘as available’ without any representation, warranties, or conditions of any kind.
- Limitation of Liability: In no case shall Kearney Family Farm, its directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of any of the service or any products procured using the service.
8. Governing Law
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New York, United States, without regard to its conflict of law principles.
